Terms of sale

These terms apply to every order placed with Top-Secured: reports, monitoring subscriptions, expert services and data. They complete our terms of service.

1. Seller and scope

The seller is Top-Secured, identified in our legal notice. Our offers are designed for businesses; a consumer may also order, and is then protected as described below. These terms apply to orders from businesses and from consumers; where the law gives consumers more protection, that protection prevails. Our terms of service govern the use of the website and of the free checks.

2. Offers and prices

Offers and prices are described on our offer pages. Prices are in euros excluding VAT; VAT is added at the applicable rate. A business in another EU country that gives a valid VAT number is invoiced without VAT (reverse charge). A quote is valid 30 days.

3. Ordering

1. You choose an offer and confirm your e-mail address with the code we send you.
2. If the offer gives the detail of a domain, you prove that you control it (a TXT record in its DNS).
3. The contract is formed when the payment is confirmed or when you accept our quote in writing.

4. Payment and subscriptions

Online payment is handled by Stripe; we never see your card number. Subscriptions renew automatically each month or each year until you cancel them. We announce any price change at least 30 days in advance; you may cancel before it applies.

5. Delivery

Reports are delivered in your customer area and by e-mail, within the time stated on the offer. Monitoring starts when your domain is proven. Expert services follow the schedule agreed in the quote.

6. Cancellation and right of withdrawal

• Subscriptions: you can cancel at any time in your customer area; the cancellation takes effect at the end of the period already paid, which is not refunded pro rata.
• Consumers have 14 days to withdraw. For a report delivered at once, you ask us to deliver it before that period ends and acknowledge that you then lose the right of withdrawal. For a service started at your request during the period, the part already performed remains due.
• Businesses have no right of withdrawal.

7. What we deliver

Our checks, reports and monitoring describe what our robot observed on the date of each measurement, following our published method. They are neither a penetration test nor a certification, and cannot guarantee the absence of weaknesses. Expert services are performed with care, under an obligation of means.

8. Two commitments

A place in our barometer is never for sale. We never sell the detail of someone else’s weaknesses: it is given only to the proven owner of the domain.

9. Liability

Our liability is limited to the amount paid for the order concerned or, for a subscription, to the amount paid over the last twelve months, except in cases of gross negligence or wilful misconduct. We are not liable for indirect damage, data loss or business interruption.

10. Personal data and confidentiality

Your data is processed as described in our privacy policy. Technical information about your infrastructure is kept strictly confidential.

11. Governing law and disputes

These terms are governed by French law. Before any action, write to us through our contact form: we answer within 30 days. Disputes between businesses fall under the exclusive jurisdiction of the competent French courts; consumers keep the protections and courts provided by the law of their country of residence.
